KN0DER TRIAL TODAY Capt. William H. DeForestcr, Chief of Detectives, said yesterday that' failure to arrest Harry Knodor, 84 South Sixth Street, when it was al leged that whisky stolen from Bert Humler, 1818 South Third Street, was found in his room, was caused by lack of direct evidence and disinclina tion on the part of Mr. Humler to prosecute Knoder. Knoder will face a charge of knowingly receiving stolen property, in the Police Court this morning.

Captain DeForcster said yesterday that Mr. Humler came to him and said that Knoder had his whisky, and that as a result of search at Knoder's home, two cases of whisky and several empty cases were found. "Humler wasn't absolutely sure that the whisky was his," Captain DeFores-ter said. "I told him that if he wanted ivnoaer arrested, I would arrest him He said: 'I don't want anybody arrest "Finally, I. went with Mr.

Humler to see District Attorney J. M. Russell wnose advice about the case was asked -ir. imssell said that there was no case against Knoder, but that the liquor could be seized and its disposl tion passed on by a Federal Judge. He said Mr.

Humler could take the liquor and use it for his own private purposes, ir it belonged to him. Knoder then relinquished all claim to tne whisky, stating to Humler: If you want it, you can have Mr. Russell sa last eht that while he had no Verv distinct recollec Hon of the case since so many similar ones have been brought to his atten tion during the last few months, he believed Captain DeForester version or the matter was correct. He said, also, that it would be neces sary for Knoder to prove the source from which he obtained the whisky in order to clear himself of any charge mat ne obtained it an Illegal man ner. If he can prove that he bought it before tho law was passed making it an offense to buy whisky, he will be immune, of course, from any penal iyt Air.
