According to Deputy Coroner Sue Wurst, death was WEATHER Associated Press PADUCAH, Ky. The last time the federal Transportion Department inspected equipment and records of Tri-State Bus Lines 461 safety violations were cited, according to an inspection report Officials of the Paducah-based firm say, however, that none of the violations cited could have contributed to last week's accident near Caneyville in which three people were killed. The violations, found in an inspection Feb. 14-15, ranged from 300 incidents of drivers failing to prepare daily logs to two cases of inoperative low-air-pressure warning devices, which are designed to signal potential brake failure, according to the report obtained by The Paducah Sun. Ernest Mann, one of two federal transportation investigators in Kentucky, said no formal charges were filed against Tri-State after the Inspection, and there has been no follow-up inspection to see if corrections were made.

Four of the violations involved the bus that crashed last week, according to the records. They included inoperative marker lights, an inoperative low-air-pressure warning device and an inoperative horn. Three wheel lugs also were found loose on the bus, leading to one of two citations against the firm for "failure to inspect and maintain vehicles to ensure safe and proper operating conditions." Billy Joe Carroll, president of the firm, defended his company's safety record. He said only 12 of the alleged violations involved equipment on buses. He said those violations were "relatively minor" and were corrected immediately after Mann's inspection.

However, Mann said violation of any federal safety regulation, even if a matter of record-keeping, is serious, and any violation could result in conditions that could lead to an accident. The Transportation Department cannot shut down a bus company, but can recommend to the Interstate Commerce Commission that a carrier's operating permit be revoked. He said he would have no comment on whether such a recommendation was made in the case of Tri-State. The 461 violations cited included 48 involving failure to properly qualify drivers and failure to maintain proper driving records; 15 of "requiring or permitting" a driver to operate at speeds greater than speed limits; and five involving inoperative lights including marker lights, turn signals, brake lights and headlights. One citation was for a cracked windshield, two for inoperative horns, one for not having a first-aid kit on a bus, and seven were for failing to report accidents in which people were injured or in which more than $2,000 in property damage resulted.

in school," he said. "It's costing me a lot of money and time." The course fee is $115, and often the students must take motel rooms all week and pay incidental expenses. The former commissioner will take his examination Friday. McGuffey's ouster caused ripples throughout the insurance industry in Kentucky, and was based, according to the governor's office, on technically 11- legal issuances of agents' licenses. I.M.

"'Ike" Gray administrative services director for the department was forced to resign at the same time. McGuffey later said he volunteered the information to the administration about "discretionary" issuance of licenses. He said all he had done was try "to use common sense with the law." He described his ouster by Carroll as "the stab wound of a friend." McGuffey also said he had been told that an attorney general's investigation of his performance in office had produced no major findings against him. Assistant Attorney General Ray Larson said, "We're trying to wind up the investigation of alleged irregularities in granting of insurance licenses during McGuffey's term as commissioner." He said he would not comment on the investigation, however, because it was not complete. However, state police are no longer guarding files in McGuffey's old office.

"I asked for an exemption from the same people who fired me, but they said they couldnt do it," McGuffey said. He said he asked Carroll administrative aide Jack Hall and deputy cabinet secretary Don Rbody. Gov.

Julian Carroll forced McGuffey to resign in October because of alleged improper handling of agents' licenses. McGuffey had been insurance commissioner since the administration of Wendell Ford, who took office in 1971. Under a law passed years ago, an agent who does not practice for five years must take a test for a new license. This since has been reduced to one year. In conjunction with the law requiring 40 hours of classroom instruction, that left McGuffey with no choice after his request for an exemption was turned down.
