Antitrust Suit Names Tobacco Buyer Here Baltimore, July 27 (AP)-Antitrust charges were filed in Federal Court here today against the buying agents of four large cigarette companies operating at the Upper Marlboro tobacco market in Prince Georges County.

The $150,000 antitrust suit was filed by A. L. Bruner, a Detroit speculator, who charged the defendant firms conspired to discriminate against him in their purchase of tobacco. Named as defendants in the conspiracy suit, brought under Sherman Antitrust are the four companies and 30 of their officers and buying agents. Companies Are Listed The companies are Edward J.

O'Brien Company, a Louisville corporation that buys for Liggett Myers Tobacco Company; W. H. Winstead Company, controlled by Baltimore interests, which buys Central for Philip Tobacco Morris Company; Leaf Company, Durham. N. P.

Lorillard Company, and Gieske Nieman Tobacco Company, buyers for domestic European cigarette companies. (Edward J. O'Brien, III, buyer for the O'Brien firm, 815 W. Main, said Friday night that Bruner's suit was "surprising," but declined to comment on the case until he has seen the briefs.) The suit does not involve the large cigarette companies, but only the buying firms that get tobacco for them in the Upper Marlboro auction. Bruner's suit charges the action of the four companies is in restraint of trade in the state and in interstate commerce.

Tobacco Sold by Bid The suit explains that tobacco brought by farmers to the auction warehouse is sold by bid to: 1, buyers; 2, speculators or resellers, and 3, warehouse buyers. Speculators try to resell the tobacco at a higher price later. Bruner's suit says that during the 1956 tobacco-selling season the defendant firms refused to Commodity Futures Generally Higher By The Associated Press Virtually all commodity futures traded on New York and Chicago markets scored strong advances yesterday. New York cotton was 25 cents to $1.20 a bale higher. Cottonseed oil advanced .2 to .28 of a cent a pound, soybean oil .28 of a cent a pound, and lard .23 to .3 of a cent, Copper was .3 to .4 of a cent pound higher, while zine climbed .04 to .1 of a cent a pound on five contracts, the liveliest trading in recent sessions.

Hides were .05 to .38 of cent a pound higher, while wool, coffee, and rubber were mixed. Wool futures declined .1 to .6 of a cent a pound, but wool tops futures were up .1 to .9 of a cent. Coffee under contracts was unchanged to .3 of a cent a pound higher, whereas contracts ranged from .3 of a cent a pound lower to .15 of a cent a pound higher. Old rubber was .7 of a cent to 1.05 pound higher, but new rubber was of a cent a pound lower to .50 higher. Cocoa lost .03 to .05 of a cent A pound, and both foreign and domestic sugar were off slightly, unchanged to .01 of a cent a pound lower.

No trades were reported in lead, tin, and silk. Corn, up to cents a bushel, and soybeans, up 13 to cents A bushel, led the grain advance at Chicago. Wheat gained to cents a bushel. while oats were up to of a cent a bushel, and rye to cents a bushel. buy, tobacco, owned Littell, by Washington attorney eM.

representing Bruner, said the large companies are trying to eliminate his client from the bidding. "Without speculators such as Bruner," Littell said, "the Maryland tobacco farmers would no place to sell their product except to buyers of the large companies. The suit charges the alleged discrimination has "a dangerous tendency to create a monopoly in, the auction sale of tobacco." Farm Prices, A On Rise Lately, Fall One Per Cent Washington, July 27 (P)- Farm prices, on the upgrade for six months to the joy of electionminded Republicans, dropped one per cent between mid-June and mid-July. The dip in the one-month period was attributed by the Agriculture Department to lower prices for fruits, meat animals, and commercial vegetables. Prices for potatoes, milk, and chickens increased, but not enough to offset the drop in other commodities.

The mid-July level was still about 8 per cent above that at the beginning of the year, 3.28 per cent above that of a year ago, but nearly 25 per cent below the record high reached in February, 1951.
